General Terms and Conditions
These General Terms and Conditions apply to all purchase orders placed by customers at the online shop www.marinsel.ch, operated by Marinsel GmbH, Lothringerstrasse 23, 4056 Basel, Switzerland. The following General Terms and Conditions shall apply exclusively, and only in such form as they are valid at the time of the customer’s placing of the order. The tender of delivery applies in Switzerland and abroad. Before sending a completed order form, our customers are asked to accept the General Terms and Conditions by clicking the field “I accept the General Terms and Conditions”. Only then an order becomes legally effective.
2. Conclusion of contract
Purchase orders to Marinsel GmbH can be placed by telephone or internet. By placing the order and accepting the General Terms and Conditions, the customer makes a legally binding purchase offer. The customer shall always receive a confirmation after placing an order.
As soon as an order has been placed via the web shop, an order confirmation is sent automatically. This confirmation is non-binding, and does not mean that the ordered merchandise is in stock at the time of the order. Marinsel GmbH can only accept orders if the ordered merchandise is available.
Once placed, an order cannot be cancelled by the customer any more. A contract closure only comes into effect with the delivery of the merchandise.
If the merchandise is no longer available from the supplier, Marinsel GmbH has the right not to execute an order and to refund any payments already effectuated by the customer.
Delivery and packaging are free of charge for regular orders in Switzerland with an invoiced value of 250 SFR or over. The costs for deliveries up to 250 SFR, for deliveries abroad and express deliveries will be fully charged at the expense of the customer. If the customer ruturns the good/s, the shipping costs to the customer will be charged afterwards and the amount will subtracted from the refund.All deliveries are sent as packages, and carried out by the Swiss postal service. This means every delivery has a tracking number that allows our customer to monitor the delivery at all times.
Benefit and risk shall pass to the customer upon dispatch of the merchandise. Marinsel GmbH is not liable for delays in delivery, or for damage sustained by merchandise during shipping. Marinsel GmbH reserves the right to make delivery in installments. New "pick up at store" option: Pick-up address for orders that already have been payed: Marinsel, Lothringerstrasse 23, 4056 Basel. Un-payed orders stay reserved for 4 days.
The price lists such as they are valid at the time of contract closure and the current foreign currency exchange rate as stated by Marinsel GmbH on the day of receiving the order shall apply. All prices are listed in Swiss Francs Euros and US Dollars including statutory value-added tax (VAT) and excluding delivery costs. VAT is deducted for orders from abroad. Any statutory VAT applicable in a given country and any customs duties are payable by the customer and will be charged by the competent customs authorities. For unaccepted and automatically returned packages, the shipping of the package will be charged for both ways.
5. Methods of payment?
Orders are payable immediately. No additional fees are charged in case of cash payment or advance payment by bank transfer. Bank transfer fees shall be at the purchaser’s expense. All other methods of payment require additional fees to be paid. These fees vary between companies:
- Bank transfer no commission
- Postfinance no commission
- VISA +2.7% fee on payment sum
- MasterCard +2.7% fee on payment sum
- PayPal +3.5 % fee on payment sum
- TWINT +2.3% fee on payment sum
The respective credit card details are transmitted by a secured HTTPS connection.
6. Right of return
We kindly ask our customers to check the ordered merchandise upon receipt. If you are not satisfied with the shipment, please note:
We can only take back merchandise:
- returned within 10 days upon receipt, and after prior announcement by firstname.lastname@example.org;
- returned in the original packaging;
- showing no signs of wear and tear;
- without any damaged or removed labels;
- sent to the postal address: Marinsel GmbH, Lothringerstrasse 23, 4056 Basel
- goods returned later than within 10 days of receipt will be reimbursed by a voucher
The customer is responsible for the returned merchandise being properly packed, and must pay the expenses for return shipment, with the exception of cases such as specified in Section 7 of these General Terms and Conditions. Marinsel GmbH inspects all returned merchandise according to the aforementioned criteria. If these criteria are fulfilled, Marinsel GmbH shall refund the corresponding amount by bank transfer or the same payment method used for payment. If the shipping was free of charge the shipping costs will be charged afterwards and subtracted from the refund amount. Any losses incurred due to exchange rate fluctuations are at the expense of the customer.
7. Damaged or wrongly delivered items
We personally inspect all merchandise before shipping. In case of any defectiveness in the merchandise, for example a non-apparent manufacturing defect, the merchandise can be returned. This also applies to faulty delivery falling under the responsibility of Marinsel GmbH.
In either of these cases, we ask you to give us prior notice of the return by e-mail or telephone. Any return shipping costs shall be at the expense of Marinsel GmbH. The customer must inspect the merchandise immediately upon receipt, and notify us of any defects within 10 days following receipt.
1 year warranty period, starting with receipt of the merchandise, in case of demonstrable manufacturing defects. The warranty does not cover wear and tear.
9. Data security
As a rule, Marinsel GmbH does not transfer any data to third parties.
Credit card details are transmitted by a secured HTTPS connection.
10. Applicable Law and Jurisdiction
Swiss Law applies exclusively. The UN Convention on the International Sale of Goods (CISG) is thus excluded. The place of jurisdiction is Basel, Switzerland.
